1. Scope
These Terms of Service govern the use of the platform omni.compare (hereinafter referred to as the "Platform"). By registering or using the Platform, users accept these terms.
2. User Content
2.1 Users may post their own content (e.g., comparisons, ratings, texts, images, videos).
2.2 It is prohibited to publish content that:
• violates applicable Swiss law, in particular the Criminal Code (StGB, e.g., racial discrimination, defamation, slander, threats, pornography), • is racist, sexist, discriminatory, extremist, harmful to minors or otherwise morally reprehensible, • violates the rights of third parties, in particular the Copyright Act (URG), trademark rights or personal rights under the Civil Code (ZGB), • contains advertising, spam or other abusive content.
3. Copyright
3.1 Users may only upload or publish content for which they have the necessary rights.
3.2 By posting content, users grant omni.compare a simple, non-exclusive, unlimited right to use the content within the platform for display, storage and accessibility purposes.
3.3 Copyrights remain with the respective authors.
4. User Responsibility
4.1 Users are solely responsible for all content they create or upload.
4.2 omni.compare assumes no liability for content posted by users.
4.3 Users indemnify the operators of omni.compare from all third-party claims arising from violations of these Terms of Service or third-party rights.
5. Deletion and Blocking
The operators reserve the right to delete content at any time or block user accounts if a violation of these Terms of Service exists or if there is reasonable suspicion.
6. Platform Availability
There is no entitlement to permanent or uninterrupted use of omni.compare. The operators reserve the right to restrict or discontinue operations in whole or in part.
7. Changes to Terms of Service
The operators may change these Terms of Service at any time. Changes will be announced on the platform in a timely manner. Continued use constitutes acceptance of the changes.
8. Final Provisions
8.1 Swiss law applies exclusively, excluding conflict of law provisions. For users residing outside Switzerland, the mandatory consumer protection provisions of their respective country of residence also apply.
8.2 The place of jurisdiction is - to the extent legally permissible - the registered office of the operators of omni.compare.
8.3 Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions remains unaffected.
